What is the difference between the FSSAI license and FSSAI registration?

Every human or Food Business Operator who is in any manner connected to the distribution, manufacturing, storage, and transportation of food products should obtain FSSAI Registration. In India, licensing or registration of the food business is governed by the Food Safety and Standards Regulations 2011. Whether you have to acquire an FSSAI License or FSSAI Registration depends upon the nature and size of your business.



FSSAI Registration

FSSAI Registration is needed for those lawgicalindia whole food Licence business operators who are included in a trivial food business. The Petty food business operator is any entity or human who:

  • Any human who sells or manufactures any article of food himself or through any other small retailer; or
  • Any seller, temporary stallholder, or itinerant vendor; or
  • Any human who distributes food in any social gathering or religious one except a caterer; or
  • Other food businesses involving a cottage or small scale or such other industries associating with tiny food businesses or food businesses having a yearly turnover of not more than Rs. 12 Lakhs and whose:
  • The food production capacity (other than milk, meat products, milk products, and meat) do not exceed 100 kg/ltr. Per day or;
  • Collection, Procurement, and handling of milk is up to 500 Litre per day or;
  • Slaughter capacity is 2 larger animals or 50 poultry birds or 10 small animals per day or less.

Eligible person/entity to acquire FSSAI Registration

All food processing units involving re-packers and re-labelers:- 

Turnover not exceeding 12 lakhs and whose food production capacity does not exceed 100 kg/ltr per day.

● Dairy units involving milk chilling units equipped to process or handle:-

Up to 2.5 MT per annum or Up to 500 liters per day.

● Units producing vegetable oil and Vegetable oil processing units by the method of solvent extraction and refineries involving oil expeller units:-

Income up to 12 lakhs annum.

● Slaughtering units:-

The huge animal is up to 2 small animals up to 10 Poultry birds up to 50 per day.

● Meat processing units:-

Income up to 12 lakhs annum.

The Process to Obtain FSSAI Registration

  • Small food business operators needed to carry out FSSAI registration, also familiar as a basic.
  • This registration can be acquired by applying to the Food and Safety Department.
  • The implementation shall be submitted in Form A.
  • The implementation for registration could be accepted or probably be rejected by the Department.
  • If the application is rejected or accepted it shall be stated by the Department within 7 days from the application submission date.
  • The Department’s decision regarding rejecting or accepting the application of the FBO should be informed in writing
  • The registration certificate granted by the Department after accepting the application shall contain the applicant’s photo and registration number.
  • At the time of sustaining the food business, the Food Business Operator must importantly display the registration certificate at the business place.

FSSAI License

It is to be obtained by any entity or humans that do not classify as a small food Licence business operator. An entity or person has to acquire FSSAI Central License or State FSSAI License online depending upon the nature and size of the business and the licensing authority does change accordingly.

Any big-scale food manufacturer, importers, processors, and transporter of food products need Central FSSAI License.

And medium-sized transporters, manufacturers, or processors need FSSAI State License.

Note: The procedure and fee to acquire an FSSAI license online are more cumbersome and extensive in comparison to FSSAI registration.

Eligible Individuals/Entity to Obtain FSSAI License

FSSAI State License:

  • Cold or refrigerated food storage companies with a capacity of up to 10,000 MT.
  • Controlled environment + Cold food storage business with a capacity of up to 1,000 MT
  • Food wholesalers with annual sales of up to Rs.30 crores.
  • Boarding Houses or Dhabas that serve food, Banquet halls with food catering arrangements, Home-based Canteens or hostel messes, Permanent or Temporary Stall Holders on streets and malls, and arrangements in Religious Gatherings or Fairs with a turnover of more than Rs.12 lakhs per year.
  • Food retailers with annual sales of up to Rs.20 crores.
  • Food distributors with annual sales of up to Rs. 20 crores.
  • Food suppliers with annual sales of up to Rs.20 crores.
  • Fish or meat or poultry shop owners or any other food vending establishment with yearly revenue of more than Rs.12 lakhs
  • Food transporters with up to 100 vehicles or annual revenue of up to Rs.30 crores
  • Hotels that are in the range of three to four stars, or hotels with a turnover of more than Rs.12 lakhs.
  • Restaurants with a revenue of up to Rs.20 crores.
  • Food manufacturers with a turnover of up to Rs.20 crores.
  • Meat processing plants are capable of processing up to 500kg of meat per day, or 150 MT per year.
  • Milk chilling units capable of handling or processing 501 to 50,000 LPD of milk or more than 2.5 MT to 2500 MT of milk solids per year
  • Units that process vegetable oil, units that produce it by solvent extraction, and refineries, including oil expeller units, with a capacity of up to 2 MT per day or a turnover of more than Rs.12 lakhs a year.
  • Slaughterhouses can handle up to 50 large animals, 150 small animals, or 1000 poultry birds per day.
  • All food processing units with a capacity of more than 100 kg per day, including labellers and repackers.
  • Food storage companies with a capacity of up to 50,000 MT but no controlled atmosphere or cold storage.
  • Milling units for grains, cereals, and pulses.

Central License:

  • Milk chilling units are capable of handling or processing more than 50,000 litres of liquid milk per day or 2500 MT of milk solid per year.
  • Vegetable oil processing units and solvent extraction units producing vegetable oil, as well as refineries including oil expeller units processing more than 2 MT per day
  • Units that slaughter more than 50 large animals, 150 small animals, or 1000 poultry birds per day.
  • Meat processing plants handle more than 500 kg of meat per day or 150 MT per year.

Except for grain, cereal, and pulse milling units, all food processing units, including labellers and repackers, process more than 2 MT per day.

Other than those with a controlled atmosphere and a cold environment, storage units with a capacity of more than 50,000 MT

  1. Cold or chilled storage with a capacity of more than 10,000 MT.
  2. Cold Storage with a capacity of over 1,000 MT and a controlled atmosphere.
  3. Wholesalers with yearly revenue of more than Rs.30 crores
  4. Retailers with yearly revenue of more than Rs.20 crores.
  5. Distributors with yearly revenue of more than Rs.20 crores.
  6. Suppliers with yearly revenue of more than Rs.20 crores.
  7. Caterers with yearly revenue of more than Rs.20 crores.
  8. Hotels with five stars or higher.
  9. Restaurants with yearly revenue of more than Rs.20 crores.
  10. Transporters with more than 100 vehicles or yearly revenue of more than Rs.30 crores.
  11. Marketers who have yearly revenue of more than Rs.20 crores.

Food catering services in establishments and units under Central Government Agencies such as Defence, etc., Storage or Wholesalers, Retailers, or Distributors with Central Government Agencies.

The Process to Obtain FSSAI License:

  • To acquire the lawgicalindia FSSAI License online the Food Licence Business Operator shall implement the Licensing Authority.
  • This application is made in Form B.
  • The application should be annexed with Annexure, self-declaration, and affidavit as applicable.
  • This license is granted for a timeline of 1 to 5 years as the time limit requested by the food business operator.
  • The higher the timeline for which a license is acquired the higher would be the application of the fee.
  • The license can be renewed by producing an application.
